On Thursday, I submitted HB 792 to help our state reduce Medicaid Fraud and Abuse. As I told you last week, our state does a better job than most in not wasting Medicaid/Medicare funds. They do a lot to track down fraudulent claims and to remove providers out of the system if they are found to be negligent. However, we are not using all the latest tools available in pursuing those who set up fraudulent companies and submit phony claims. What’s happening now is that the Department of Health and Mental Hygiene (DHMH) is “paying and chasing“. In other words, they are finding fraud but usually after a payment has already been made. What my legislation seeks to do is promote a strategy of checking all claims and providers on the front end, especially when they are first starting to submit claims. Obviously, once a company or health care provider is in the system, you don’t have to check their validity each time they send a claim.

On Wednesday, I was in attendance for Governor O’Malley’s speech, which was a ‘grab bag’ of fuzzy math and warmed-over failed policies. Governor O’Malley believes that dramatically increasing regressive taxes like the gas tax, sales tax, and small businesses will somehow create jobs. He says that his administration has made $7.5 billion in spending cuts, but during the past six years the budget has grown by over $6 billion since the 2007 special Session tax increases – which were supposed to fix the budget deficit back then.

The 2012 Legislative Session started on Wednesday, January 11, 2012 in Annapolis. It’s my second serving as a State Delegate. While I always try to be positive, there is no question but that this Session is shaping up to be probably the most challenging that I have ever observed. Others who have been here much longer agree.We arrived the first day to headlines in the press that Governor O’Malley was suggesting another sales tax increase, from 6%-7%. This is on top of his proposals to raise the gas tax 15 cents per gallon, increase budget spending by nearly $1 Billion, pass a large chunk of the cost of teacher pensions back to the counties, and ban septic systems for developments of five houses or more which would devastate land values for farmers and hurt our already struggling building and trades industry.
